That is completely normal and expected behavior. When you are in a 1x area and are actively transferring data then your phone's only communication path with the tower is being "taken up" by the data transfer (hence incoming calls will go to VM). If your data connection is connected but dormant (which it would be most of the time) then calls can ring through.
That all changes when you're in an EV-DO area. Regardless of if you are actively transferring data or not, the 1x channel is still open to receive notice of an incoming call--so your calls will always ring through.
