Smartphonesource.com to give away a free 7135!

OK, here's the scoop...

We're going to play a little guessing game..... For a suggested $5 donation to the site, you can submit a guess as to which day and time the 7135 will be officially released. The winner will receive a brand new 7135 from Kyocera Wireless!

For members with 100 or more posts (as of 10-14-02 3:00pm Central Time):
Starting on October 17th at approximately 12:00 noon, Central Time Zone a new thread will be posted in the 7135 General Discussion Forum. This post will state that the contest is now open. Members wishing to participate will need to send a private message to Jazz with three choices in order of preference for your guess. Guesses will be granted in the order the Private Messages are received. If your guess is already taken, you will be offered the opportunity to make a new guess.

Once you've submitted your guess, you'll need to send your suggested $5 donation via online payment source, or we can give you a snail mail address.


For members with 50 or more posts (as of 10-14-02 3:00pm Central Time):
Starting on October 18th at approximately 12:00 noon, Central Time Zone a new thread will be posted in the 7135 General Discussion Forum. This post will state that the contest is now open. Members wishing to participate will need to send a private message to Jazz with three choices in order of preference for your guess. Guesses will be granted in the order the Private Messages are received. If your guess is already taken, you will be offered the opportunity to make a new guess.

Once you've submitted your guess, you'll need to send your suggested $5 donation via online payment source, or we can give you a snail mail address.


For remaining members registered as of 10-14-02 3:00pm Central Time:
The contest will be opened up to these members based on availability of dates on October 21st at 12:00 noon, Central Time Zone.


Days will be split into AM/PM so there will be a maximum of 2 guesses per day (1 for Am and 1 for PM). AM/PM will be decided based on the Central Time Zone. So, if an annoucement is made at 10:45 am Pacific Time, It will be considered as 12:45 pm Central Time and therefore the winner will be the PM guessor.

The "Actual time of release" will be the first public announcement by either carrier announcing that they will be selling the 7135. Exact time will be determined by Smartphonesource.com's representative at Kyocera.

Participating members are only allowed one guess.

Accepted guesses will be viewable on the board calendar, accessible through the link entitled "Calendar" at the top of each page.

If the phone is released on a day or time which no members guessed, the phone will be given to the "nearest guessor".
Example #1: If the phone is released on Monday PM and no one has taken that slot, the member who has Monday AM will win the phone.
Example #2: If the phone is released on Tuesday AM and the nearest guessor's are Monday AM and Wednesday AM, it will be considered a tie with the phone going to the guessor with the highest post count.

SmartphoneSource.com reserves the right to cancel the contest and refund all donations at any time.
Smartphonesource.com shall not be held liable for any technical errors that occur and/or mail lost in the USPS handling system.
Smartphonesource.com will determine the winner in any "tie" situation.
Void where prohibited by law.

So what about the users who may have more posts than they currently have but got nuked on that username screwup and had to re-register?
Not to be a pain in the ass but this post count thing isn't exactly the fairest way to handle this, especially considering a lot of people were affected by this.

to be brief, this contest is completely unfair and should not be held. if you need money for the website you need to ask for donations outside of a giveaway. not to mention the giveaway is biased because unless you revise the rules the beta testers out there will have the best advantage. I dont want to even get into the legalities you could be getting yourself into with this. I'd recommend that you rethink this whole idea.

FOR THE RECORD ... while I risk getting "flamed" for my comments, I want you to know that I'm ONLY offering "perspective", NOT "opinion".

Just like everyone else, I'm looking forward to the 7135. And I've relied on smartphonesource.com for info, discussion, and yes ... hype! I've got two friends who WILL buy it on Day One.

Having said that ...

... I KNOW that your Smartphone release "pool" is intended as a cool activity for all of us -- BUT, isn't this an "illegal raffle"?

I KNOW that office pools occur all over the world ... I guess that the fact that THIS pool is out in the open on the Web concerns me!

Again folks, all I'm doing is offering perspective.

And now ... let the flames rise!

JJ is on his way to a meeting with our lawyer...

We had really hoped to give away a phone, and thought this would be a fun game and a way to reward those who have made this place the knowledge base that it is.... It was also suggested to us to have this contest as a fund raiser for the board. We were trying to find the best way to do that....

Unfortunately we seem to be getting a negative response (mostly from users with less than 50 posts). We may just have to cancel the whole thing and not give away the phone at all....

I hope it doesn't come to that. I have seen several times where sph-i300 has given away software and accessories provided to them by vendors, much like you are doing with the 7135 that Kyocera has provided to you. The fact that you are requesting donations to benefit the site should not have any bearing on whether the contest is "legal". Only people that want to participate will... nobody is being forced into it.

I don't know what exactly some members are trying to suggest... that the contest simply be cancelled because they don't like the rules? I don't think I read many constructive suggestions on how it could be done better.

I think it's very fair the way you have done it. Everyone is invited to participate. The most valuable contributors have better odds. They don't give out frequent flyer miles equally... the more you fly the more you get. That's the way that most things work in the world, isn't it?

Hey,
I think its great that you want to do this but I think that it would be better if the entry into the pool was not so biased. Some of us dont have the time to post and dont always have a question or something of importance to add (today just happens to be an exceptionally slow day at work). When I do I always come here and someone has answered it or already added it. I do benefit from what I have learned and thank the people who share the knowledge but its not right to penalize me because I dont have "the inside scoop". Not to mention that since there are only 78 or so days until the end of the year that doesnt leave much for other people who want in.

No offense, but, again, that's how life is. You get back what you put into something. When my company has their annual "employee of the year" award presentation the person who wins is the person who people felt contributed the most during the year. Is a person who comes in late and leaves early every day because they have to get their kids to/from school being unfairly discriminated against because they are unable to make the same level of committment that some are willing to make?

78 days = 156 guesses. When you get to the 156th member you are down to members with 22 or less posts... and how many of those posts were necessarily related to the 7135? And do you expect that there will be 100% participation? I doubt that seriously. There are still rumors of a February '03 release. Somebody with 1 post might be the only one who picks a date that is not in this year.

JJ and jazz are just trying to do something nice to reward the loyalty of their members. Why turn something positive into a negative?

7135 giveaway

Regarding the smartphone 7135 giveaway....

I recently found this site while looking for a release date for the 7135. I recently signed up and became a lurker as I didn't feel comfortable yet responding to these threads.

Now, at first glance I see I am completely excluded from this contest because I don't have enough posts. (serves me right for sparing you all from my aimless drivel...)

So my selfish recommendation would be that you restart the guess on a future date and allow everyone to submit there guesses for the release date and am/pm time block. The person with the earliest post date with that time stamp wins. Granted you will get a deluge of posts at one time but your server shouldn't crash and it would seem fair to all. I don't have a solution for rewarding the people for large numbers of posts, except maybe a one time thank you by sending them 5%-25% discount coupons for purchases...

OK- I said my piece and have to add the following for the people who made it this far. Hopefully one or two of you will thank me for this software suggestion to download.
I have a QCP-6035(was one of the early adopters...) I enjoy it tremendously. My favorite software is the Seattle Traffic software. I select it while on my commute and within 12 seconds I get, up to the minute, maps that show traffic congestion in the seattle area. Very valuable for people who commute. I am sure that other citys have this software available. My apologies if this has been posted before. Just trying to help people out who might not have seen this software yet, although it has been out for at least 18 months...
I found this software on the Avant Go website. Hope this helps!

As suggested by Smartphonesource.com's lawyers, There has been addendum posted to the rules stated in the first post of this thread.

On another note... There will be more contests and games in the future in which every member will be eligible with no preference given to post count and no donation required.
