If you have TEP and it's not a obvious user damage, you should get it waived. (In fact, the only time I've had to pay out to get my phone replaced was when I smashed in the screen on my 6601 due to pressure from the closure of a belt pouch; I had just had it replaced for charging issues before, and got it replaced a few months later for charging issues. That one is currently dead in a cradle on my desk).
