GSM networks do not blacklist ESNs like CDMA carriers do. A SIM is the only thing that regulates that and thats why you have to buy a new SIM. As far as wanting to ban someone for who you THINK has a stolen phone and NOT KNOWING, you should be ashamed. For all we know this person is buying refurbed on the side or mulitples in a pallet lot auction or somewhere else.
